He had drank a few beers, but spread them out over several hours, so he felt safe to drive. and our client was coming home alone after a night out with co-workers. In the following case, our 42-year-old client was allegedly traveling at 86 miles per hour and lane straddling on the westbound 91 Freeway approaching the 110 – 91 interchange. We sent it to the Compton DA’s office and no case was filed. Our office then received the MVARS tape, which showed no lane straddling and no speeding. He then submitted to a preliminary alcohol screening (PAS) test and blew 0.08% twice. for allegedly speeding 86 miles per hour and lane straddling on the 91 Freeway. In a Nutshell: No file in a DUI case involving an arrest at 1:20 a.m. The CHP often will release the MVARS to our office with a proper request and advance payment of a copying fee. The CHP usually makes the traffic stop, so MVARS (mobile video audio recording system) tape can be reviewed to verify what the CHP officer claims our client did. Judge Fortner volunteers with several organizations in Douglas County. Judge Fortner also serves on the Legislative Committee of the Counsel of Accountability Court Judges. Since its inception, the Accountability Court has graduated 151 participants and saved the county over $850,000.00 in jail costs. Judge Fortner oversees the Moderate Risk track of the Douglas County Misdemeanor DUI and Drug Accountability Court. He returned to the district attorney’s office as the Chief Assistant District Attorney in 2012 and was elected District Attorney in 2014. Sonny Perdue appointed him as Solicitor General of Douglas County and he was elected to that position in 2008. After being admitted to the State Bar of Georgia in 2000, Judge Fortner served as a prosecutor with the Douglas County District Attorney's Office for over six years. ![]() Judge Fortner earned his bachelor’s degree in political science from North Georgia College and State University and a law degree from the Georgia State University College of Law. Prior to his appointment, Judge Fortner served as the Douglas County District Attorney.
